About this policy

This policy explains how we collect, use, store and disclose your personal information, and how you can access it, correct it, or make a complaint.

It covers both of our businesses and applies to our workshops, our websites, our social media pages, and any dealings you have with us by phone, email or in person.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles.

In this policy, "we", "us" and "our" refer to Geelong Performance Centre Pty Ltd in its capacity as trustee for the GPC Trust, and to both workshops it operates. "You" refers to any person whose personal information we hold.

What we collect

We only collect personal information that we need in order to do our work.

When you become a customer or make an enquiry, we may collect:

  • Your name
  • Your phone number and email address
  • Your postal or street address
  • Your vehicle details, including registration number, VIN, make, model and build date
  • Records of the work we have carried out, including diagnostic data, tune files, dyno results and service history
  • Payment details, processed through our payment provider (we do not store your full card number)
  • Notes from conversations with you about your vehicle and what you want from it

When you visit our websites, we may collect:

  • Information you enter into our contact, enquiry or newsletter forms
  • Your IP address, browser type and device information
  • Pages you viewed, how you arrived at our site, and how long you stayed
  • Information collected through cookies and similar technologies

When you interact with us on social media, the relevant platform collects information about you under its own policy. We may see your public profile, your comments, and any messages you send us.

Sensitive information

We do not seek to collect sensitive information as defined by the Privacy Act. If you volunteer it to us — for example, mentioning a medical condition that affects how you use your vehicle — we will only use it for the purpose you gave it to us.

Anonymity

You can deal with us anonymously or under a pseudonym for general enquiries. We cannot carry out work on a vehicle, issue an invoice, or honour a warranty without knowing who you are.

How we collect it

Most of the time, we collect personal information directly from you — when you book work in, fill out our workshop form, call us, email us, submit a form on our website, or message us on social media.

Sometimes we collect information about you from someone else. For example:

  • From the registered owner of a vehicle you have brought in on their behalf
  • From a business that has referred you to us
  • From an insurer, finance company or fleet operator, where they are arranging the work
  • From publicly available sources, such as a business website

Where we collect your information from a third party, we will take reasonable steps to make sure you are aware of this policy.

Why we collect it and how we use it

We use your personal information to:

  • Quote, book and carry out work on your vehicle
  • Contact you about your vehicle, including progress updates and collection
  • Keep a service and tuning history so we can support the work we have done
  • Issue invoices and take payment
  • Handle warranty claims, follow-up work and any issues that arise
  • Meet our obligations under Australian Consumer Law and any other applicable law
  • Respond to your enquiries
  • Improve our websites and our services
  • Send you marketing about our products and services, where you have not opted out
  • Deliver advertising to you, and to people similar to you, through platforms such as Meta and Google

We do not use your personal information for any purpose unrelated to the above unless you would reasonably expect it, or we have your consent, or the law requires it.

Direct marketing and advertising

We may contact you with information about our products, services, promotions and events, by email, SMS, post or telephone.

We may also disclose your contact details to advertising platforms including Meta (Facebook and Instagram) and Google so that we can show advertising to you, and so those platforms can identify other people with similar interests. Where we do this, your details are converted into a scrambled form (hashed) before they are sent, and the platform is not permitted to use them for its own purposes.

You can opt out at any time. Use the unsubscribe link in any email, reply STOP to any SMS, or contact us using the details at the end of this policy. We will action your request as soon as practicable and will not charge you for it.

If you opt out, we will still contact you about work in progress on your vehicle, warranty matters, safety recalls and anything else we are legally required to tell you about.

We may also disclose personal information where the law requires or permits it — for example, to a court, a regulator, or a law enforcement agency.

Overseas disclosure and access

Some of the providers we use are based overseas or operate global networks through which personal information may be processed, accessed or transferred. This includes providers based in the United States and other countries, as identified above.

Our Workshop Software environment is hosted in Australia, with customer data stored within infrastructure maintained separately for the Australian environment. While the data is stored in Australia, authorised access to that environment may occur from outside Australia in limited circumstances.

Our websites also use international content delivery, security, analytics, advertising and other services. As a result, information collected through our websites may be transferred to, stored in, or accessed from overseas locations.

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it in a way consistent with the Australian Privacy Principles where required by law. However, we cannot guarantee that an overseas recipient will always comply with Australian privacy law, and you may not be able to seek redress under the Privacy Act in relation to an overseas recipient.

Our websites

Enquiry and newsletter forms

Contact, enquiry and newsletter forms on our websites are handled within our own website system and stored on our website server, which is located in Melbourne, Australia. We may also receive a copy of your submission by email.

We keep form submissions for 12 months and then delete them, unless you have become a customer, in which case your details are held in our workshop records as described elsewhere in this policy.

Cookies and website tracking

Our websites use cookies and similar technologies. These are small files placed on your device that let us recognise your browser and understand how the site is used.

The following are currently in use across our websites:

  • Meta Pixel — records the pages you visit and reports this to Meta, so we can show advertising to people who have visited our websites and measure whether that advertising leads to enquiries
  • Google Analytics 4 and Google Tag Manager — measures how our sites are used, including pages viewed, time on site and general location
  • Google reCAPTCHA v3 — used on our enquiry forms to prevent automated spam
  • Embedded Google Maps — shown on our contact pages
  • Elfsight social feed widgets — display our Instagram and social content on our websites
  • Cloudflare and Amazon CloudFront — deliver our website content securely and quickly

You can block or delete cookies through your browser settings. Some parts of our websites may not work properly if you do.

You can also manage advertising preferences directly with the platforms:

  • Meta — through your Facebook or Instagram ad settings
  • Google — through Google Ads Settings, or by installing the Google Analytics Opt-out Browser Add-on
  • Industry-wide — youronlinechoices.com.au

If you would prefer not to be tracked for advertising purposes and are having trouble doing so, contact us and we will help.

How we keep it secure

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These include:

  • Password protection and access controls on our systems
  • Restricting access to those in our business who need it
  • Hosting our websites on a server located in Australia, behind a security and traffic-filtering service
  • Using reputable third-party providers with their own security controls
  • Physical security at our premises for paper records
  • Staff awareness of their privacy obligations

No system is completely secure. If we become aware of a data breach that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme.

How long we keep it

We keep personal information for as long as we need it for the purposes set out in this policy, and for as long as the law requires.

In practice, that means we retain customer and vehicle records — including tune files and service history — for the life of our relationship with you and for a period afterwards, because that history is often needed to support warranty claims and later work on the same vehicle. Financial records are kept for at least seven years as required by Australian tax law. Website form submissions are kept as described above.

When we no longer need personal information and are not required to keep it, we take reasonable steps to destroy it or de-identify it.

Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you at any time. You can also ask us to correct anything that is inaccurate, out of date, incomplete, irrelevant or misleading.

To make a request, contact us using the details below. We may ask you to verify your identity.

We will respond within a reasonable period, usually within 30 days. There is no charge for making a request, though we may charge a reasonable fee for the cost of providing access where a request is substantial.

If we refuse a request, we will tell you why in writing and explain how you can complain.

Complaints

If you think we have breached the Australian Privacy Principles or mishandled your personal information, please tell us first. Contact us using the details below with as much detail as you can, and we will investigate and respond in writing, normally within 30 days.
